Cookie regulations out to confuse
Nearly two months after the deadline passed for the implementation of the new cookies regulations, it is estimated that as many as 4/5 businesses have chosen to ignore the ICO’s directives and ‘sit it out’, despite the risk of heavy fines for the worst offenders.
Reasons for this range from absolute ignorance of the new legislative requirements, to fury and frustration over implications these have on their businesses and the potential loss of data captured via Google Analytics. It is true that there have been mixed messages over the directive, and that its roll out has been hampered by last minute changes to the definition of ‘implied consent’.
In addition, some quarters of UK business see the regulations as over kill, and akin to opening Pandora’s box, whereby customers and site visitors that were largely ambivalent to the usage of cookies have now become confused over the reasons why cookies are necessary and opt out, rather than allow cookies to run. The downside to this is the user experience is dramatically reduced and webmasters find themselves with a lack of useful data used to optimise sites and digital campaigns
What to do?
What we can’t get away from is that all sites are required to actively adopt the ICO’s directives. It doesn’t have to be complicated, and with the right support and advice, a Cookie Usage Policy can be quickly adopted, and a brief given to your web developers to ensure compliance.
